Memorandum
of Agreement
June 10, 2004
KNOW MEN BY THESE
PRESENTS:
This Memorandum of
Agreement entered into on the 10th day of June, 2004 in Manila, Philippines
by and among:
The PHILIPPINE
SPORTS COMMISSION, a government agency created under Republic Act
No. 6847 which is tasked to oversee and direct the country's sports development
program, with office address at Rizal Memorial Sports Complex, P. Ocampo
Sr., St., Malate, Manila, duly represented by MR. ERIC R. BUHAIN, in his
capacity as the Chairman of PSC, referred to as the PSC;
The DEPARTMENT OF HEALTH, a government agency with office address
at San Lazaro Compound, Rizal Avenue, Sta. Cruz, Manila, duly represented
by MR. MANUEL M. DAYRIT MD, MSc, in his capacity as the Secretary of Health,
referred to as the DOH;
The PHILIPPINE OLYMPIC COMMITTEE, a private entity serving as the
official National Olympic Committee of the Philippines and the umbrella
organization of the various national sports associations, with office
address at 3rd floor, PICC, CCP Complex, Roxas Boulevard, Pasay City,
duly represented by MR. CELSO L. DAYRIT, in his capacity as the President
of the POC, referred to as the POC;
The PHILIPPINE SOUTHEAST ASIAN ORGANIZING COMMITTEE, a special
body created by virtue of Executive Order No. 126 issued by Her Excellency
President Gloria Macapagal Arroyo to ensure the comprehensive planning,
preparation and successful staging of the 2005 SEA Games in Manila, duly
represented by HON. ROBERTO PAGDANGANAN, in his capacity as Chairman of
the Philsoc, referred to as the PHILSOC;
The WORLD HEALTH ORGANIZATION-PHILIPPINES, an international organization
under the United Nations jurisdiction which primarily caters to worldwide
promotion and advancement of health issues and concerns, with office address
at National Tuberculosis Center, DOH Compound, Manila duly represented
by DR. JEAN-MARC OLIVE, in his capacity as the WHO Representative in the
Philippines, referred to as the WHO-PHILIPPINES;
The DEPARTMENT OF INTERIOR & LOCAL GOVERNMENT, a government agency
with office address at Gold Condominium Building, EDSA, Quezon City, represented
by HON. JOSE D. LINA, in his capacity as Secretary of the DILG, referred
to as the DILG;
The DEPARTMENT OF EDUCATION, a government agency with office address
at University of Life-ULTRA, Meralco Avenue, Pasig City, duly represented
by HON. EDILBERTO DE JESUS, in his capacity as Secretary of DepEd, referred
to as the DEPED;
The VARIOUS NATIONAL SPORTS ASSOCIATIONS, privately-organized entities
and duly accredited members of the POC that are mandated to pursue programs
and activities to further promote and develop their respective sports
nationwide, with office addresses in various parts of Metro Manila, represented
by their respective presidents and general secretaries, referred to as
the NSAs;
The FCTC ALLIANCE-PHILIPPINES, a non-governmental organization
that is in the forefront of promoting the advocacy of tobacco control
in the country with office address at the Philippine Heart Center, duly
represented by DR. MARICAR BLANCO-LIMPIN, in her capacity as the President
of the FCAP, referred to as the FCAP;
The PHILIPPINE CANCER SOCIETY, INC., a non-governmental organization
with office address at 310 San Rafael St., San Miguel, Manila, duly represented
by DR. ROBERTO PATERNO, in his capacity as the President of the PCS, referred
to as the PCS; and
The TEAM PHILIPPINES, members of the elite National Pool from different
sports disciplines who represent the country in prestigious international
sporting events such as the SEA Games, Asian Games and the Olympic Games,
duly represented by MS. GRETCHEN S. MALALAD, referred to as the TEAM PHILIPPINES.
WITNESSETH
WHEREAS, the Philippines hosts the prestigious 23rd Southeast Asian (SEA)
Games considered as the most important international event next year in
the country;
WHEREAS, the Philippine government is a signatory to the international
treaty called the Framework Convention on Tobacco Control, committing
itself among others to the worldwide action to prevent, in all forms,
tobacco promotion through sports - consumption, advertising, exposure
to second-hand smoke and marketing;
WHEREAS, the new law Republic Act 9211 and its enabling Implementing Rules
& Regulations encourage the local sporting community to observe and implement
tangible measures to ensure that the use of tobacco will not in any way
promoted in the local sports system, programs and activities as well as
in all its facilities and complexes used for sports and recreation purposes;
WHEREAS, the country's hosting of the 2005 SEA Games presents an opportunity
to concretely popularize and further heighten the level of tobacco control
advocacy;
WHEREAS, the WHO has directly partnered with the International Olympic
Committee to ensure that tobacco and harmful products are not unwittingly
promoted through sports and that tobacco-free Olympics tradition began
at the 1988 Winter Olympic Games in Calgary, Canada and has been observed
in succeeding editions of the Olympics;
WHEREAS, the first tobacco-free SEA Games was launched during the 22nd
edition of SEA Games in Hanoi, Vietnam;
WHEREAS, there is a collective effort to similarly develop, orient and
declare the 23rd edition of the SEA Games a tobacco-free event;
NOW, THEREFORE, for and in consideration of the foregoing premises
and the obligations hereinafter provided, the parties hereto have agreed,
and do hereby agree, with each other as follows:
ARTICLE
1
CONTRIBUTIONS AND PARTICIPATION OF CONTRACTING PARTIES
A. PHILIPPINE SPORTS
COMMISSION
1. To serve as the over-all Chair and Secretariat of the Tobacco-Free
23rd SEA Games program.
2. To take charge in the organization, coordination and linkaging of activities,
undertakings and all the necessary preparations for the smooth implementation
of the program.
3. To provide personnel, including logistics who will supervise the day-to-day
operations of the Secretariat.
B. DEPARTMENT OF HEALTH
1. To serve as the Deputy Over-all Chair of the organizing Secretariat
of the Tobacco-Free 23rd SEA Games program.
2. To assist in the preparation and sourcing of technical resources/logistics
needed in the implementation of the program.
3. To conceptualize and develop IEC materials and advocacy-information
strategies to promote the thrusts and visions of the program.
C. FCTC ALLIANCE-PHILIPPINES
1. To serve as the over-all Secretary General of the Tobacco-Free 23rd
SEA Games program.
2. To lead in the supervision of the operations and activities of the
program, specifically in the pooling and training of the base of volunteers
for the program.
3. To coordinate and link with local and international tobacco control
advocates and organizations to ensure the active participation of civil
society in the program.
D. PHILIPPINE OLYMPIC COMMITTEE
1. To officially declare the 23rd edition of the SEA Games as tobacco-free.
2. To help ensure that tobacco consumption, advertising and marketing
will not be allowed prior and during the staging of the 23rd SEA Games.
3. To facilitate, allow and assist in the implementation of programs and
activities to be undertaken by the Tobacco-Free SEA Games Task Force before
and during the staging of SEA Games.
E. PHILSOC
1. To officially declare the 23rd edition of the SEA Games as tobacco-free.
2. To help ensure that tobacco consumption, advertising and marketing
will not be allowed prior and during the staging of the 23rd SEA Games.
3. To facilitate, allow and assist in the implementation of programs and
activities to be undertaken by the Tobacco-Free SEA Games Task Force before
and during the staging of SEA Games.
F. WORLD HEALTH ORGANIZATION-PHILIPPINES
1. To act as an executive member of the Tobacco-Free 23rd SEA Games Task
Force/Secretariat.
2. To provide technical assistance in the planning, monitoring and evaluation
of activities and projects to be lined up by the programme.
3. To provide information materials, researches and other related studies
on smoking, health and sports.
4. To help identify or source technical resources and adequate funding
for the programme.
G. DEPARTMENT OF EDUCATION
1. To act as an executive member of the Tobacco-Free 23rd SEA Games Task
Force/Secretariat.
2. To issue the necessary memorandum/order/directive to all its regional
offices nationwide propagating the thrusts and objectives of this undertaking,
including the participation and involvement of its personnel, when necessary,
to the program.
3. To extend support and assistance that may be required in the implementation
of activities and programs of the Tobacco-Free SEA Games Task Force.
H. DEPARTMENT OF INTERIOR & LOCAL GOVERNMENT
1. To act as an executive member of the Tobacco-Free 23rd SEA Games Task
Force/Secretariat.
2. To issue the necessary memorandum/order/directive to all its regional
offices nationwide propagating the thrusts and objectives of this undertaking,
including the participation and involvement of its personnel, when necessary,
to the program.
3. To extend support and assistance that may be required in the implementation
of activities and programs of the Tobacco-Free SEA Games Task Force.
I. NATIONAL SPORTS ASSOCIATIONS
1. To act as coordinating members of the Tobacco-Free 23rd SEA Games Task
Force/Secretariat.
2. To commit their respective organizations in preventing the promotion
of tobacco products in all forms prior and during the staging of the SEA
Games.
3. To ensure that tobacco-control advocacy will be incorporated in their
respective sports programs and activities even after the conclusion of
the 23rd edition of SEA Games.
J. PHILIPPINE CANCER SOCIETY
1. To act as an executive member of the Tobacco-Free 23rd SEA Games Task
Force/Secretariat.
2. To assist in the coordination, planning and organization of relevant
projects and activities for the program in partnership with local and
international tobacco control advocates and other organizations to ensure
the active participation of civil society and the private sector.
K. TEAM PHILIPPINES
1. To serve as members of the Tobacco-Free 23rd SEA Games Task Force/Secretariat.
2. To support and assist in the implementation of programs and activities
to be lined up by the Tobacco-Free 23rd SEA Games Task Force/Secretariat
specifically in its promotion and advocacy initiatives
ARTICLE
II
SEPARABILITY CLAUSE
If for any reason,
any part of this Agreement may be found to be invalid, contrary to law
or otherwise rendered ineffective, the other provisions not affected shall
remain in force and in effect.
ARTICLE
III
REPEALING CLAUSE
This Agreement repeals,
amends, modifies or supercedes any and other agreements or parts of agreements,
or agency policy, order or regulations inconsistent herewith.
ARTICLE
IV
EFFECTIVITY
This Agreement takes
effect immediately and shall continue to be in full force and effect unless
terminated by any of the parties herein in writing, subject to 30-day
notice.
IN WITNESS HEREOF,
the parties have hereunto caused their signature to be affixed this 10th
day of June 2004 in Manila, Philippines.
